01Who we are

Stateside operates a technology platform that connects you with independent, licensed healthcare providers and licensed pharmacies. Stateside is not a pharmacy, a medical practice, or an insurer, and it does not practice medicine or dispense medication. Clinical decisions are made solely by the providers, and medications are dispensed solely by the pharmacies. The provider–patient relationship is between you and the treating provider.

02Eligibility

You must be at least 18 years old, a resident of a state or territory we serve, and able to form a binding contract to use our services. You agree to provide accurate, current, and complete information during intake and to keep it up to date. Services are intended for use only in the locations where we operate and may not be available everywhere.

03Not for emergencies

Our services are not designed for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Do not use the platform to seek emergency or urgent care.

04Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at admin@statesidescripts.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a safety, security, or legal risk.

05Memberships, billing & subscriptions

Some services are offered on a recurring subscription or membership basis. By enrolling, you authorize Stateside and its payment processors to charge your payment method on the cadence disclosed at checkout until you cancel. Prices, fees, and what is included are described at the point of sale and may change with notice. Unless stated otherwise, fees do not include the cost of medication, which is billed separately by the pharmacy.

Medication subscriptions may be canceled at any time through your account or by contacting our support team. Cancellation stops all future shipments and charges going forward; it does not retroactively refund a period already started, except as described in our Refund Policy.

06Medical services & prescriptions

Completing an intake or purchasing a product does not guarantee that a provider will prescribe any particular treatment, or any treatment at all. A provider may determine that a requested treatment is not appropriate for you. All prescribing decisions are at the independent clinical judgment of the treating provider. Please review our Consent to Telehealth and the relevant safety information before starting treatment.

07Acceptable use

You agree not to misuse the platform, including by providing false information, attempting to obtain medication for anyone other than yourself, reselling or diverting medication, reverse-engineering or disrupting our systems, or using the services for any unlawful purpose.

08Intellectual property

The Stateside name, logo, content, and software are owned by Stateside or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the services for your personal, non-commercial use. You may not copy, modify, distribute, or create derivative works without our written permission.

09Disclaimers

Except as expressly stated, the services and platform are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or secure. This section does not limit any warranty that cannot be excluded under applicable law.

10Limitation of liability

To the fullest extent permitted by law, Stateside and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the services. Our total liability for any claim relating to the services will not exceed the amount you paid to Stateside in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be limited by law. This section does not apply to the independent clinical services of providers or the dispensing services of pharmacies.

11Indemnification

You agree to indemnify and hold harmless Stateside and its affiliates from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the services.

12Dispute resolution & arbitration

Any dispute arising out of or relating to these Terms or the services will be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and Stateside each waive the right to a jury trial and to participate in any class-action lawsuit or class-wide arbitration. You may opt out of arbitration within thirty (30) days of first accepting these Terms by sending written notice to admin@statesidescripts.com.

13Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except where superseded by applicable federal law or by mandatory consumer-protection laws of your state of residence.

14Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and, where required, provide additional notice. Your continued use of the services after changes take effect means you accept the revised Terms.
